USE OF JCN SERVICES CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS:

1. JCN AND ITS MANAGEMENT DISCLAIM ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
   
2. JCN will not be responsible for any damages, including direct, indirect, consequential or incidental, that a third party may suffer. This includes, but not limited to, loss of data resulting from delays, non-delivery, miss-delivery, or service interruptions as a result of JCN or user actions. User explicitly assumes all risk and indemnifies and holds harmless JCN against any damages that may arise due to viruses, worms, Trojan Horses, logic bombs, trap doors, and other computer diseases and security violations that are obtained or exercised through JCN services.
   
3. It is the responsibility of the user to ensure that the correct phone number is programmed into the dialer. JCN will not be responsible for any long distance charges incurred.  It is the users responsibility to ensure the number their computer is dialing is a local call.
   
4. User explicitly acknowledges that JCN exercises no control over the content or nature of any information passing through JCN. User also assumes the entire risk as to the accuracy and nature of any information obtained or received through JCN services. User also agrees that JCN has no control over what personal information user might put out on the Internet and is not responsible for any charges user might incur because of said personal information (be careful who and where you give personal information. I.E. your address, phone number etc).
   
5. User agrees to pay any damages which may be claimed against JCN or its management for any losses incurred by JCN or its management because of user storing, retrieving or cause to store, retrieved by or on JCN equipment, copy written or pornographic materials or information.
   
6. User agrees not to establish web servers, ftp servers, mass e-mailing or utilize programs which maintain a constant connection on a non-dedicated dial-up account. Users agree not to use IRC BOTS on any type of connection. (These conditions constitute a dedicated connection and when discovered will be charged as such.) User agrees not to resale any services provided to them by JCN, Inc.

Billing Agreement.

JCN INC invoices for service will be submitted monthly in advance via email or postal mail. User agrees to pay monthly invoices upon receipt of invoice, not later than the first of each month, and until user account is cancelled by written notification. Regardless of requested termination date, user accounts are terminated at the end of the billing period. If the User cancels an account early and it is paid ahead the account will be disconnected on the first of the upcoming month, the User will not receive any partial refund or credit. Service cancelled after the first of the month is subject to charges for the current month.

There will not be any refunds on prepaid accounts or packages for existing service

Accounts with an unpaid balance as of 9:00 A.M. (CST) on the 10th day of the month, will subject to suspension of service without notification to the user (unless prior arrangements have been made).  Such suspension does NOT relieve user of payment obligation and including invoiced amount & reconnection fee.  A reconnection fee of $5.00 will be assessed.  Service will not be reactivated until full payment including reconnection fee is received.  Written or E-mailed cancellation notification is the ONLY means of account termination and release of payment obligation.  If the amount due to JCN INC is not paid, and it is necessary to take steps to collect on debt, user agrees to pay all reasonable collection cost, including attorney fees and court cost, that are necessary to collect said debt.  User understands that any returned check (for any reason) will result in a a $25.00 service charge and immediate suspension of a user account.

JCN will return to sender any electronic mail received for terminated users.

Users acknowledge that use of JCN services is a privilege granted by JCN and can be revoked at any time. JCN and its management reserve the right to terminate a user account and any implied right to access JCN services at the sole discretion of JCN or its management.

ALL USE OF JCN SERVICES MUST BE FOR LAWFUL PURPOSES. USE OF JCN SERVICES IN VIOLATION OF ANY APPLICABLE FEDERAL, STATE, OR LOCAL LAW OR REGULATION IS PROHIBITED AND WILL RESULT IN TERMINATION OF SERVICE

DIALUP ACCOUNT POLICY

DIALUP ACCESS DOES NOT MEAN DEDICATED ACCESS.
A standard dialup account is ONLY a part-time connection to the Internet.

Please follow these 3 simple rules.

1.) Idling is not allowed. If your not using the Internet, Please logoff. Our system will automatically disconnect you if you are idle for 20 minutes.If you do not know how to log off then please call our tech support line.

2.) You CANNOT stay connected 24 hours a day. If you disconnect and reconnect immediately it will be considered as staying connected. Standard dialup accounts are only PART-TIME connections to the Internet. If your needs constitute more than a PART-TIME connection please contact the sales office regarding DEDICATED account.

3.) Only 1 login at a time please. If our system detects more than 1 login at the same time, you will be billed for a second account every month.
